Welcome to the website “fitclub-x” (hereinafter: “the Site”).
The Site is an online platform for purchasing fitness products, training courses, and coaching services (hereinafter: “Products”).
The Terms are written in masculine form for convenience but apply to all genders using the services (hereinafter: “Users”).
Introduction:
You are requested to carefully read the Terms and Conditions of Use (hereinafter: “Viewing” and “Purchasing”) of the Site in full as a prerequisite to engaging with the Site. Your use of the Site and/or registration to the Site and/or subscription to its newsletter constitutes your agreement to comply with these Terms and the registration and purchase conditions. It is emphasized that neither you nor anyone on your behalf shall have any claim or demand against the Site.
If you have reservations or do not agree with these Terms, you are asked to refrain from using the Site.
It is clarified that the Terms apply to any viewing and/or use of the Site on any end device – whether via computer or other communication devices (such as mobile phones, tablets, etc.).
The Terms and any document that replaces them may change from time to time at the sole discretion of the Site, without any obligation to provide prior notice.
Product images displayed on the Site are for illustration only. Differences may occur between the images and the actual delivered products.
It is forbidden to use the Site for illegal purposes.
The Site management may change product prices at its discretion without prior notice.
Customers registered on the Site may subscribe for free to the newsletter sent to the email address provided during registration. At any time, the user may request removal from the mailing list.
Registration and Purchase Process:
9. Any person, including a company or legal entity incorporated in Israel or abroad, may use and/or register to the Site subject to the following conditions:
a. The user declares they are legally competent to perform binding legal actions.
b. You are at least 16 years old.
c. The user owns a valid email address.
When registering, you must provide personal details to verify your identity, including: first and last name, email address, mobile number, and any additional details requested at registration.
The user commits to providing truthful identifying information and not impersonating anyone else.
The Site management undertakes to keep user details confidential as far as possible and use them solely for their intended purpose unless required by law. The Site will not be responsible if the information is lost and/or accessed by hostile parties through means beyond its control.
The Site determines how your information is used. By registering/purchasing, you agree to provide all required data and undertake to ensure its accuracy. The Site may send updates via email, including content updates, information about products and services, and promotions, as defined by Section 31a of the Communications Law.
To purchase a product, select it and add it to “Add to Cart.” To complete the purchase, you must enter personal details: full name, delivery address, phone number, email, credit card details, and any other required information. These must be filled in accurately to avoid delays.
Payment on the Site will be accepted via valid credit cards. Payment approval will occur only after verifying credit card details and approval by the credit card company. Knowingly providing false information constitutes a violation of these Terms and may result in legal action.
If payment is not approved, the order will not be charged or completed. Notification of non-completion will be sent to the email provided. The customer may settle payment within 2 business days. Otherwise, the order will be canceled without any claim against the Site.
After payment approval, a confirmation email will be sent. Product delivery will begin only upon final approval, and the charge will occur simultaneously.
Product purchase is subject to availability. The Site is not obligated to supply products that are out of stock and does not guarantee inventory replenishment.
Prices on the Site are final and include VAT. The final charge may also include delivery fees.
Delivery Process and Shipping Options:
20. Delivery begins after final approval of the purchase.
21. Orders after 5:00 PM will be processed the next business day.
22. Business days exclude Fridays, Saturdays, holiday eves, and holidays.
23. Delays caused by force majeure are not the Site’s responsibility.
24. Delivery will be made via “Tapuz” courier to the address provided. Delivery fees appear on the purchase page.
25. “Tapuz” delivery will arrive within 3 business days. Remote areas and Eilat: up to 5 business days, subject to the courier’s terms and delivery zones.
26. During holidays, delivery times may extend beyond the stated timeframes. We will make every effort to deliver as soon as possible.
27. Self-pickup is not available.
28. Once dispatched to the final sorting center, the recipient will automatically receive a message confirming the shipment is on its way. Before delivery, another message will notify the customer of the courier’s arrival.
29. If the package is returned due to refusal of delivery, incorrect address, or moving without prior notice, it will be resent upon coordination and with additional shipping fees.
30. Customers must immediately notify of any delays or issues. Failure to do so is solely their responsibility.
31. Shipping costs and delivery times will appear during purchase and apply only within Israel.
Intellectual Property:
32. This Site contains original content owned by fitclub-x and content it is authorized to use. All intellectual property rights, including the Site’s design, information presentation, images, graphics, applications, code, and text, belong to fitclub-x or third parties who allowed its use.
33. Use of the Site does not grant any rights to use its intellectual property. Any violation of copyright or intellectual property will entitle the Site to close the user’s account without notice and to claim any related expenses without limiting other remedies.
34. No part of this content may be copied, publicly displayed, distributed, performed, transmitted, modified, processed, sold, or rented without prior written consent. Use of trademarks or logos without explicit written approval is prohibited.
35. Violations will result in account closure and liability for all resulting expenses and damages.
Data Collection:
36. The Site may collect and store information resulting from use of the Site.
37. Additionally, standard data collection about users may be performed to improve user experience and personalize content.
38. By using the Site, you consent to the use and transfer of non-identifying information to third parties, as long as it does not personally identify you.
39. All collected information will be retained for the above purposes and will not be shared with third parties.
40. Cookies technology enables the Site to deliver personalized content. Cookies are text files stored on your system, allowing analysis of Site usage for service improvement.
41. Without limiting the above, the Site may assign its obligations and rights under these Terms to any third party at its discretion, transferring your data accordingly. By using the Site, you consent to this.
Order Cancellation and Product Returns:
42. The Site’s policy is subject to the Israeli Consumer Protection Regulations (Cancellation of Transaction), 2010.
43. Cancellation of a purchase agreement may be done within 7 days of receiving confirmation of the transaction by contacting customer service by phone and providing customer and order details.
44. You may receive a refund if you contact customer service within 14 business days and the items are returned in their original packaging. Sale items are eligible for store credit only. Refunds will incur a 5% fee plus shipping costs.
45. Refunds will be processed to the credit card used for the purchase per the credit card company’s policy. Cash purchases will be refunded by bank transfer. Direct debit and prepaid cards are only eligible for store credit.
46. Returns must be made within 14 days in original packaging, with labels, unused, undamaged, and unaltered.
47. For returns of shipped items, the product price will be refunded, but shipping costs will not.
48. After this period, no cancellations or refunds will be possible.
49. Defective items must be reported immediately. They should be sent to the address in the “Contact Us” section to receive a replacement if available. Return shipping for defective items is at the Site’s expense.
50. For clarity, no returns or refunds will be accepted for medicines, dietary supplements, training courses, except in cases of shipping error or defective delivery conditions.
Site Liability:
51. The Site does not guarantee that use will be secure, accurate, uninterrupted, error-free, virus-free, or free of harmful components. The Site is not responsible for damages resulting from such factors.
52. The Site strives for continuous availability but cannot guarantee uninterrupted service. In case of downtime, the Site will restore service as quickly as possible. No compensation will be provided for interruptions.
53. The Site is not responsible for improper use of products by customers contrary to manufacturer instructions.
54. The Site may, at its sole discretion, cease operating the Site and/or its services without notice. The user acknowledges the Site bears no responsibility regarding the termination of the platform or data loss.
Governing Law:
55. These Terms and their interpretation shall be governed by the laws of the State of Israel. Exclusive jurisdiction over any dispute shall rest with the competent courts in the Tel Aviv District.
